LIMITED WARRANTY
Resa Corporation warrants that:
 | the RASP, RSWS, and all RASP Application Software will perform substantially in accordance with the
accompanying written materials for an average of twenty (20)
days/month from the date of receipt of the RASP Account | |
| any Support Services
provided by Resa shall be substantially as described in applicable
written (published) materials provided to you by Resa Corporation,
and Resa Corporation support engineers will make commercially
reasonable efforts to solve any problem. | |
To the extent allowed by
applicable law, implied warranties on the RASP, RSWS, and RASP
Application Software, if any, are
limited to ninety (90) days. Some states/countries/jurisdictions do
not allow limitations on duration of an implied warranty, so the
above limitation may not apply to you.
Resa Corporation's and its suppliers' entire
liability and your exclusive remedy shall be, at Resa Corporation's
option, either:
| return of the price paid for the RASP Account, if any | |
| repair of the RASP software that does not meet Resa
Corporation's Limited Warranty. | |
This Limited Warranty is void if
failure of the RASP, RSWS, and RASP Applications Software has resulted from accident, abuse,
hacking practices, Internet-related problems, or misapplication.
Product support services offered by Resa Corporation are never
available without proof of purchase of a RASP Account from an
authorized source.
NO OTHER WARRANTIES. TO THE MAXIMUM EXTENT PERMITTED BY
APPLICABLE LAW, RESA CORPORATION AND ITS SUPPLIERS DISCLAIM ALL
OTHER WARRANTIES AND CONDITIONS, EITHER EXPRESS OR IMPLIED,
INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OR CONDITIONS OF
MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND
NON-INFRINGEMENT, WITH REGARD TO THE SOFTWARE, AND THE PROVISION OF
OR FAILURE TO PROVIDE SUPPORT SERVICES. THIS LIMITED WARRANTY GIVES
YOU SPECIFIC LEGAL RIGHTS. YOU MAY HAVE OTHERS, WHICH VARY FROM
STATE/COUNTRY/JURISDICTION TO STATE/COUNTRY/JURISDICTION.
LIMITATION OF LIABILITY. TO THE MAXIMUM EXTENT PERMITTED BY
APPLICABLE LAW, IN NO EVENT SHALL RESA CORPORATION OR ITS SUPPLIERS
BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL
DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS
OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS
INFORMATION, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OF
OR INABILITY TO USE THE SOFTWARE OR THE FAILURE TO PROVIDE SUPPORT
SERVICES, EVEN IF RESA CORPORATION HAS BEEN ADVISED OF THE
POSSIBILITY OF SUCH DAMAGES. IN ANY CASE, RESA CORPORATION'S ENTIRE
LIABILITY UNDER ANY PROVISION OF THE RESA END-USER LICENSE AGREEMENT
SHALL BE LIMITED TO THE GREATER OF THE AMOUNT ACTUALLY PAID BY YOU
FOR THE RASP ACCOUNT OR U.S.$5.00; PROVIDED, HOWEVER, IF YOU HAVE
ENTERED INTO A RESA SUPPORT SERVICES AGREEMENT, RESA CORPORATION'S
ENTIRE LIABILITY REGARDING SUPPORT SERVICES SHALL BE GOVERNED BY THE
TERMS OF THAT AGREEMENT. BECAUSE SOME STATES/COUNTRIES/JURISDICTIONS
DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY, THE ABOVE
LIMITATION MAY NOT APPLY TO YOU.
